CAPE CORAL, Fla.- In a room with more than a dozen inmates,  Matthew Marshall was up first to face a judge. The 33-year-old was arrested for using his father's credit card at a local Cape Coral bar, just a day after he disappeared.

James Rick Marshall was last seen or heard from on February 16th. He was supposed to be going to California for work. He was a no-show and would not answer calls, texts or e-mails, which was unusual for him. That's when a coworker requested he be checked on.

On February 19th, James Marshall was officially reported as missing. His missing person's case quickly turned into a murder investigation.

Sources close to the investigation say his body was found dismembered out in the woods near him home.

Police have not tied his son, Matthew Marshall, as a suspect in the case. They are not revealing any suspects at this time.

Matthew Marshall will remain behind bars until his fraud case is determined. He is expected to be in court on April 7th.

While police are tight-lipped about any suspect in the case, people living around the area say they're anxious for answers.  "Are they even looking at the son as a suspect though? The fact that all that happened with the credit card and all?"

How James Rick Marshall died and who killed him is still unknown, but neighbors say they're confident that in time, even the smallest detail will soon help make a bigger revelation.

"These things take a while. Since it happened so recently, I'll give it some time," A resident said. "If it doesn't get resolved in a short amount of time, then, there will be cause to worry."
