Son of missing realtor arrested in fraud case

CAPE CORAL, Fla. -- New details are emerging about a mysterious death investigation concerning the disappearance of a Cape Coral realtor.

58-year-old James Marshall is now presumed dead. He was reported missing by a business associate last week after he failed to show up for a conference in California.

Police now say that Marshall's son, Matthew Marshall, was charged with defrauding a restaurant after he allegedly tried to use his father's credit card to pay a $50 tab at Backstreets Bar the day after his father was last seen.  Investigators say he then reportedly left the place without paying after the card was declined.

As of Thursday morning, police say they do not consider Matthew Marshall a suspect in his father's death, and they haven't even said whether this case is suspicious.
