VW loses Fla. Lemon Law case

UPDATE: The Florida Lemon Law board just ruled in favor of the South Florida driver who brought a claim against Volkswagen over the diesel scandal.

They will have to buy back the car. Volkswagen can appeal the decision.

There is another consumer listening to what happens as he now wants to bring a lemon law claim.

EARLIER: A hearing is being held Wednesday on the Volkswagen emissions scandal in front of the Florida Lemon Law board.

Walter Melnyk, an 86-year-old Jupiter resident, is bringing the case after he bought a diesel VW just months before the manufacturer was caught cheating. He's worried about his health and the value of the car.

Volkswagen tried to get WPTV removed from the hearing, fearing it may impact the boards decision. They asked the three arbitrators if they felt uncomfortable with the news media's presence and the board told Volkswagen's attorney that they would not be swayed by the media.

This is a public hearing and WPTV was allowed to stay.
