TALLAHASSEE, Fla. -- A Florida state judge ruled Friday that medical marijuana users can smoke marijuana.

The Florida medical marijuana statute prohibited smoking as a form of using marijuana. Judge Karen Gievers ruled that the ban was unconstitutional. In her ruling, she says users must be able to use the form of treatment their doctor recommends, including smoke-able marijuana.

But, users must smoke in private and have a prescription for medical marijuana.
