Murder victim had restraining order against husband

4 in Your Corner has obtained new documents from the Cape Coral Police Department that indicate a man who killed himself and his estranged wife, may have violated a restraining order.

The statement shows Jason McGuire chased his estranged wife Madonna with a hammer on November 30th.  Fearful for her safety, she filed aggravated battery charges against her husband.

McGuire was released from the Lee County Jail December 2nd.  One week later, both Jason and Madonna were killed in a murder suicideat her Cape Coral home.

"We definitely see how threats can become real, and people can actually act on those threats, so that's why we don't take those threats lightly, said Clinical Director of the Abuse and Counseling Treatment Center of Ft. Myers.

ACT provides counseling and legal advice to victims of domestic violence.

Because of the violent nature of the first attack, we wanted to know if Jason was required to an ankle monitoring device.

4 in Your Corner reached out to the state's attorney and the Lee County Sheriff's Office to see if McGuire was wearing one until his next court appearance, but didn't hear back.

Calderin says even if he was wearing one there no guarantee it's fully monitored.

"We definitely don't want people to assume that this is a complete safe method of monitoring where these individuals are."
