CAPE CORAL, Fla. — Cape Coral Police responded to the 1300 block of SE 24th Avenue due to shots fired call.

A man identified as Virgil Whipple, 49, was seen walking to the rear of his residence with a rifle and shots were heard a short time later.

As Officers were arriving, they heard gunshots coming from the rear of this residence.

Whipple was firing his weapon in a wooded area behind his residence beyond the Cape Coral City limits.

Additional Officers and Lee County Deputies arrived.

Officers began speaking with Whipple and asked him to step out of his residence and instructed him to keep his hands raised.

Whipple began to put his hands in his pocket.

Whipple would not follow Officers' commands on the scene and was taken into custody and charged with Resisting an Officer Without Violence.
