FORT MYERS, Fla. - The Florida man suspected in a Lee County girl's disappearance, is appealing his conviction.

Jorge Guerrero-Torres was sentenced to 40 years in federal prison on August 14th, for production and possession of child pornography.

His attorney tells Fox 4, he has received a notice of appeal on his conviction.

Back in May, Guerrero was found guilty by a federal jury of producing child pornography of Diana Alvarez, who has been missing for more than a year.

She disappeared from her San Carlos Park home back in 2016.

Guerrero was only facing child porn charges because lewd images of Diana were found on his phone.

Investigators have also recently charged him with molestation and battery.

He has not been charged in Diana's disappearance.
