FORT MYERS, Fla. – As we near the end of questioning by the prosecution in the murder trial of Mark Sievers, many are wondering if Sievers will take the stand in his defense.
Tuesday, the judge brought this up to Mark's attorney.
"If you have to talk to him again whether or not he would like to testify or not, probably the weekend will be a good time to do that," said Judge Bruce Kyle.
"I have explained that the decision to testify or to not testify is exclusively Mr. Sievers's decision," said defense attorney Michael Mummert.
So the defense is not ruling out Mark Seivers testifying in his trial. We have spoken to local attorney Mike Chionopoulos about this possibility. He says, in his words, it would be crazy for the defense to allow Mark Sievers to take the stand. He says it's too risky, because it opens him up to be questioned by the state.
