Son of murdered realtor due in court Wednesday

FORT MYERS, Fla. -- The son of a murdered Cape Coral realtor is expected in court Wednesday on a charge unrelated to his dad's homicide investigation.

Matthew Marshall has been in jail for weeks and is expected to appear in court, where his attorneys are hoping he'll get house arrest.  Police have not said he's tied to the murder of his father, James Marshall.

Matthew Marshall was charged with defrauding a restaurant after using his father's credit card at a local bar the day after he went missing.  But speculation is swirling about the gruesome homicide investigation after sources tell Fox 4 that the body of James Marshall was found dismembered, days after being reported missing.

A look at Matthew Marshall's Twitter account reveals tweets he made leading up to his father's death.  He writes: "God brainwashes people into fighting for him. He is not here because he would be killed in one second."

Another tweet says: "Didn't know what it is like to have family not blackmailed into using me. Didn't understand what family is." 

Fox 4 reached out to Cape Coral Police, and without revealing any additional details, they say it's an ongoing investigation.  "We also don't want to reveal what we do know to the potential suspect. It's law enforcement 101," says Sgt. Dana Coston.

Matthew is expected to be in court Wednesday afternoon at 1:30pm in downtown Fort Myers.
